BREEDING CONTRACT 2004

I, ____________________________,
(hereafter referred to as Mare Owner) agree to breed my
mare __________________, to the Swedish Warmblood stallion Amorex
for
the
season of 2004. Contract shall be for a stud fee of $600 for shipment
of frozen semen. I understand that there is NOT a Live Foal Guarantee.
It is a two year contract; if the mare is not pregnant within
this time, the stallion owner shall be considered to have
fulfilled all contractual obligations and any guarantees.
Mary
Baechler, Magpie Farm, agrees to provide frozen semen from Amorex
to the named mare of Mare Owner above, subject to the following conditions:
Deposit and
Fees
Stud fee is $600. Of this amount, $300 is a non-refundable
booking fee, which is due with the contract. The balance is
due when the mare is pronounced 45 days in foal by a licensed veterinarian.
A
deposit of $200 to cover shipping expenses is due before any
semen can be shipped. Any unused
balance of shipping deposit shall be credited towards the total stud
fee, provided mare gets in foal. If mare is not in foal, unused shipping
deposit shall be refunded in October 2004.
The
first shipment of frozen semen has a $100 tank filling fee plus
all round-trip shipping expense. This is because we must
purchase liquid nitrogen before your shipment, to charge the Dry
Shipper. Please order frozen semen at least two weeks before your
mare will need it. That way we can ship at the least expensive
option (given the needs of other customers).
Frozen
Semen Straws:
Magpie farm will ship three
straws of frozen semen from Amorex. This should be enough for
at least two heat cycles;each straw is a full breeding dose.We recommend
breeding within six hours of ovulation. Mare owner must return all
unused straws, at
mare
owner's expense,
either when the mare is in foal, or the two years of this contract
have
expired. Mare owner may arrange to have their veterinarian
keep any unused straws, for the next season, provided another Frozen
Semen Contract for Amorex is entered into.
Mare
Care Agreements:
Mare owner hereby verifies that mare is in good health, and agrees
to provide a veterinary certificate (Please see Mare Health Form)
that a uterine culture and cytology shows that the mare is free from
infection and is in sound breeding condition prior to breeding.
The Mare Owner understands and agrees to have the mare inseminated
by a licensed,experienced equine reproduction veterinarian. Your
vet must be experienced with frozen semen, and have their own liquid
nitrogen
storage tank.
Mare
owner understands that palpations and ultrasounds by a veterinarian
are part of the normal breeding process, and it is mare owner's responsibility
to discuss those fees and services with their veterinarian before
breeding. Those fees are mare owner's responsibility. Typically, they
may be $500 to $800 per heat cycle.
Mare owner agrees to vaccinate the mare for rhinapneumontis
per their veterinarian's instruction between the 5th and 9th month
of pregnancy. Mare owner also agrees to have the veterinarian ultrasound
for twins between day 15 and 20 of possible conception. Failure to
do so makes the contract null and void. (You don't want twins, and
it is so hard on a mare to lose them late in pregnancy).
Mare owner agrees to pay for all costs of shipping the Dry Shipper
(frozen semen) canister round-trip, and to return the shipping canister
within three days to Mary Baechler, Magpie Farm. A late
fee of $25 per day will be charged for every day past 5 days
from the
time the
shipping canister arrived at your veterinarian's (It must be in Yakima
no later than Day 4 from the day your vet received it). Magpie
Farm
will issue shipping documents for round-trip shipping of the Dry
Shipper.It is your responsibility to make sure your veterinarian
returns the container promptly; we need it for other clients. Shipping
canister must be returned in good condition and with all parts;
Mare
Owner agrees to pay for replacement parts or whole container, if
lost.
Mare
owner agrees that the semen will only be used the mare named in
this
contract and is for one foal, only. If any other mare is bred without
Magpie Farm's written approval, then a penalty fee of three times
the
breeding
fee is
due
from the mare owner named in this contract. In the event of a dispute,
mare owner agrees that the venue all legal proceedings will be
in
Yakima County, WA. The mare owner agrees to pay all collection
costs, including attorney fees, court costs, necessary travel expenses,
postage or express mail fees, etc necessitated or reasonable incurred
by Magpie Farm or collection agency if there is late payment of
any
fees. Mare Owner agrees to pay all fees agreed upon in this agreement,
including 1.5% per month finance charges for late balances. A breeding
certificate will not be issued unless all fees due to stallion owner
are paid in full. If there are unpaid balances per the terms of
this
contract, Magpie Farm is not required to perform these services until
payment is made.
Upgrade Provisions:
At any time during the term of this contract, the mare owner may opt
to upgrade to Magpie Farm's current 2004 Fresh-Cooled Semen Contract,
with Live Foal Guarantee. This is only available with Mare Owner's
written agreement to pay the full stud fee for fresh-cooled semen for
Amorex.
In during so the mare owner agrees to the terms and conditions of said
contract.
All
fees
due (ie
shipping)
must
be
paid
in full,
before
the
upgrade can occur, and the terms of this contract must have been followed.
If frozen semen has been shipped, than that will be considered equal
to
the "first
collection"
provision
of
the
Fresh-cooled
contract. So there will be a normal $175 collection fee, for each shipment
of fresh-cooled semen from Amorex. This right to upgrade is subject
to occasional times when Amorex is not available, if he is at shows
or clinics. Mare owner must sign a current Fresh-Cooled Contract for
Amorex if an Upgrade is desired.The term of the Upgrade contract stays
within the two years of this original contract.
Mare Owner must return the following:
• Mare Passport; We send this to your vet, when
we ship semen. Your Veterinarian signs and returns this after
breeding.
It is Mare Owner's responsibility to see that this is returned
at the end of the current breeding season.
• Mare Health Form-due before semen can be shipped
• A copy of your mare's registration papers-due with contract
• Photo of your mare-due with contract
Use of this mare is subject to the acceptance of Magpie Farm (but
mostly it is fun to see the photos!)
Magpie farm is not responsible for any lost, delayed or damaged semen.
It is the Mare Owner's responsibility to request insurance for the
container or semen during shipment.
Embryo
transfers must be approved in advance, and are subject to private
treaty. One stud fee is due for each resulting embryo.
In
addition, this contract shall cannot be assigned or sold without
Magpie
Farm's consent. In the event of the mare's death or being unfit to
breed, this contract is null and void, and can only be transferred
to another mare with Magpie Farm's consent. In the event of the sale,
injury or death of the stallion, Magpie Farm reserves the right
to fulfill contract
with frozen semen from said stallion. Magpie Farm and Mary Baechler
shall not be liable or responsible for any disease, accident or
injury
to the mare to be bred, nor shall the owner of the mare be responsible
for any disease, accident or injury to the named stallion. Amorex
is an approved Swedish stallion, and Mary Baechler agrees to provide
the breeding certificate. It is the mare owner's responsibility
to
verify the registration requirements for the foal, which also include
DNA typing for mare and foal.
